If you got married in another
country, does the UK now
recognise that marriage?
The easy answer is ‘yes’. If full marriage
is legal in the country where you tied the
knot and you have the correct paperwork
to prove you have done it, then you
are recognised as married in the UK.
However, to keep in mind that only a
few countries around the world recognise
same-sex marriage, so don’t expect to
emigrate to a country and automatically
be recognised as married. This will
only be the case if you have moved to a
country where same-sex marriage is legal,
but check the regulations in the country
in question to ensure this is the case.
Has the situation changed if
you are transgender?
Whereas in the past you would be
compelled to divorce after gender
recognition, as of March 29th you can
now stay married if you wish. The only
issue that has arisen is that you will need
to provide evidence of consent from
your wife/husband before you face the
panel if you are already married. So in
a sense, recognition of your new gender
depends upon the consent of your current
spouse, which is not ideal in a good many
situations and can delay the process of
recognition.
